The woman, identified in inspection records as R9, scored a 6 on the Brief Interview for Mental Status, a score that indicates severe cognitive impairment. She told inspectors on September 22 that she hadn't received her trust fund money that month. A facility administrator later told inspectors that R9 doesn't receive personal funds because her family serves as her representative payee, and that R9 is aware of this arrangement. R9's own account of the situation suggested otherwise.
The man, R10, also scored a 6, indicating moderate cognitive impairment. His Trust Fund Withdrawals Affidavit from August 26 shows a $200 withdrawal by a family member. A separate signature form from September 11 documents an additional $60. R10 told inspectors he had no power of attorney, that his daughter had previously held that role, but that he is now married. He said he signs for his daughter to receive his personal funds each month.
The Social Security issue surfaced separately. A facility representative, identified as V21, acknowledged that the previous method of handling one resident's Social Security benefits was incorrect after a third-party auditor flagged it. The auditor told her that Social Security requires representative payees to manage beneficiary funds directly, and that family members or power of attorney holders are not acceptable substitutes. V21 said she would follow Social Security's guidelines going forward and that the resident and the family member involved had been notified.
The facility's own resident fund policy, dated January 2009, states its primary purpose is to protect the personal funds of residents managed on their behalf.
R10 told inspectors he hadn't received any trust fund money. He said he would appreciate it if he did.
