None of that was happening consistently.
When inspectors spoke with the charge nurse on the afternoon of September 2, she confirmed residents were not supposed to smoke unsupervised and acknowledged that an unsupervised resident with a cigarette was both a fire hazard and a safety hazard. She said a resident could get burned or start a fire. She did not know whether any resident had ever burned themselves, ignited something, or smoked near oxygen equipment.
The administrator said the same thing, almost word for word. She told inspectors she had not known residents were smoking alone outside. She said the facility's previous policy had allowed residents to smoke without supervision if they were capable of doing so, but that the current policy required staff to be present. She was not aware of any burns, fires, or injuries. Her plan was an in-service for staff and a reminder to residents.
The head of the resident care department said residents could hurt each other, get burned, or have a medical emergency if left unsupervised while smoking. She also could not say whether anyone had been hurt.
No resident was identified as having been burned or injured. Inspectors classified the violation as minimal harm with potential for actual harm, affecting a small number of residents.
The question left unanswered was how long staff had been leaving residents outside with cigarettes and no one watching.
