(Staff #07) informed the LPN of the same allegation that Staff #05 had penetrated the resident's rectum with a finger. Following this discussion, the LPN had the CNA contact the Director of Nursing DON to report
the allegation. The LPN reported that the DON gave the directive for Staff #05 to continue his shift on the 500 hall. An interview was conducted with the Social Services Director (SSD/Staff #31) on October 8, 2025 at 1:30 p.m. The SSD reported that it did not meet facility expectations that allowed Staff # 5 to continue working on the same floor as the resident, as this would still provide potential access to the resident, placing the resident at risk. The SSD stated that the policy was to remove an alleged perpetrator for resident protection. Staff #31 further reinforced that even if Staff # 5 was reassigned to a different hall, there remains a possibility that the CNA could still have access to the resident.An interview was conducted with
the facility's Resource Director (Staff #100) on October 8, 2025, at 2:03 p.m. The Assistant Director of Nursing (Staff #500) and the Interim Executive Director (Staff #28) were present during the interview. An
interview with the Director of Nursing (DON/Staff #1) was requested; however, Staff #100 served as the DON's proxy, as the DON was traveling and unavailable. The DON's proxy revealed that once the CNA informed the nurse of the allegation of sexual abuse, the expectation was for Staff #05 to be immediately suspended and sent home. The proxy further stated that allowing Staff #05 to complete his shift did not meet facility expectations, as protocol requires suspension of the alleged perpetrator pending the investigation.Review of the facility's Abuse-Identification of Types policy, reviewed May 6, 2025, defined sexual abuse includes unwanted intimate touching of any kind, especially of the beasts or perineal area.
Review of the facility's Incident and Reportable Event Management policy, reviewed September 25, 2024, revealed that in response to allegations of abuse, the facility must prevent further potential abuse while the investigation is in progress. Review of the facility's Resident Rights policy, reviewed November 19, 2024, revealed that the facility must protect and promote the rights of the resident.
