A registered nurse was present at the time of the inspection. She confirmed the open date on the vial. She confirmed it should have been discarded.
Elk Haven's own policy, dated January 27, 2026, states the facility shall not use discontinued, outdated, or deteriorated drugs or biologicals, and that any such drugs must be returned to the dispensing pharmacy or destroyed. The vial had been sitting in the medication room for more than six weeks.
Inspectors reviewed three medication rooms during the May survey. The expired vial was found in one of them.
CMS rated the violation as minimal harm or potential for actual harm, affecting few residents. The deficiency was cited under Pennsylvania codes governing management, pharmacy services, and nursing services.
