The October incident at Golden Years Center for Rehab and Healthcare began when LPN D helped a certified nursing assistant lay Resident #13 down after lunch. According to witness statements, the nurse immediately began arguing with the resident about complaints made to corporate officials.

"LPN D was arguing with the resident telling the resident that he/she was saying things to the corporate people about him/her, and he/she did not appreciate it," CNA D wrote in a witness statement dated October 28. The resident became upset and told the nurse to leave the room.
Before departing, the nurse looked directly at the resident and asked "what are you dumb?" according to multiple witness accounts.
The resident told inspectors the comment was particularly hurtful because "I have been called dumb my whole life." A medication technician who entered the room after the incident found the resident visibly upset and crying.
"The resident had issue with being called dumb, because the resident said that is what his/her father had always called the resident," CMT C told investigators. The resident was "visibly angry and upset when telling them about the incident."
The confrontation continued in the hallway, where CNA D overheard the nurse refer to the resident using a profane term while claiming the person was "trying to get him/her in trouble."
LPN D offered a different version of events during questioning, claiming the resident had become agitated and called the nurse dumb first. The nurse said the response was sarcastic and unintended as harmful.
"He/She responded sarcastically yeah you are dumb, but did not mean it," according to the inspection report.
But multiple staff members contradicted this account. The certified nursing assistant who witnessed the exchange said the nurse initiated the confrontation by yelling at the resident about corporate complaints before making the demeaning comment.
The resident's reaction was immediate and severe. Beyond the tears witnessed by staff, Resident #13 told inspectors about wanting to avoid all future contact with the nurse.
"He/She did not want LPN D to be his/her nurse anymore," the resident said during an October 29 interview. "He/She wanted to move rooms so the LPN would not be his/her nurse."
The request represented a significant sacrifice for the resident, who told investigators: "He/She really liked his/her roommate and hated to move rooms, but he/she did not want LPN D to be his/her nurse ever."
An admissions coordinator who processed the resident's formal grievance described behavior changes following the incident. The resident, normally not one to complain about staff, was "visibly upset and crying" when reporting that the nurse had also threatened to withhold medications and recreational activities like puzzles.
"The behaviors were out of character for the resident," the coordinator noted.
The interim director of nursing acknowledged the severity of the violation during inspector interviews. "If a staff member called a resident dumb that would be a violation of the resident's dignity," the administrator said, confirming that such behavior would result in termination.
An investigation was launched immediately following the resident's complaint to facility leadership. The interim nursing director told inspectors that "if LPN D violated Resident #13's dignity then the LPN would be terminated."
Federal regulations require nursing homes to treat residents with dignity and respect, prohibiting staff from using demeaning language or behavior that could cause psychological harm. The violation was classified as causing minimal harm with potential for actual harm to few residents.
The incident occurred during what should have been routine care assistance. CNA D had sought help transferring the resident to bed after lunch when the confrontation erupted over the resident's previous complaints to corporate officials.
According to the witness statement, the nurse's anger was specifically directed at the resident's communication with facility ownership about care concerns, suggesting potential retaliation for exercising complaint rights.
The resident later attempted to reconcile with the nurse, telling LPN D that "the resident was sorry," according to the nurse's account. But the damage appeared lasting, with the resident maintaining the request to change rooms to avoid future encounters.
Staff members who observed the aftermath described a person deeply affected by the verbal abuse, crying and expressing hurt feelings that connected to a lifetime of similar treatment. The resident told investigators the nurse had "really hurt his/her feelings" and "treated him/her mean."
