Galion Meadows: Resident Hurt in Van Crash Violation - OH
GALION, OH. The wheelchair tipped toward the driver's seat, and the man strapped into it couldn't stop it. The transport staff member, identified in inspection records only as TS #101, called 911. Local police arrived. The fire department arrived. EMS arrived. They cut the seatbelt on the power wheelchair to get him out, lifted him onto a stretcher, and took him to a hospital.
The resident, identified in federal inspection records as Resident #10, had been riding in a facility transport van. He uses a Quantum Q6 Edge H.D. Power Chair, a heavy motorized wheelchair. When the van came to a stop and TS #101 looked back, the chair had tipped over and was close to her seat.
What held Resident #10 in place during the ride was a positioning belt, the kind built into power wheelchairs to keep a person from sliding forward or slumping down. The owner's manual for his specific chair, dated February 2020, is explicit on page 27: the positioning belt is not designed for use as a restraining device. It is not designed for use as a seatbelt in a motor vehicle. The manual includes a warning label saying exactly that.
Federal inspectors who investigated the complaint, filed under Complaint Number 2635799, cited the facility for actual harm to a few residents. The citation level, F0689, covers accidents and supervision failures. Inspectors rated the harm as having actually occurred, not as a risk.
A separate manual reviewed during the inspection covered the QRT-360 4-Point Wheelchair Securement System, the kind of restraint system designed for use in vehicles. That system requires a pelvic belt and a shoulder belt used together, worn flat against the body, not twisted, not held away from the occupant by parts of the wheelchair frame. The manual for that system states the two belts should not be used individually because doing so compromises the entire system's performance. It also requires regular inspection, cleaning, and maintenance, with any damage or defects reported to an authorized dealer.
There is no indication in the inspection record that the QRT-360 system, or anything like it, was in use when Resident #10 was transported.
TS #101 told inspectors she could not recall whether the wheelchair was still locked to the van floor when the chair tipped. She remembered seeing it tipped over and close to her seat when she stopped. She called 911. Then she moved the van and parked it in a nearby grocery store parking lot. Then she called the facility's administrator.
The sequence matters. EMS cut the belt to free Resident #10. That belt, the one they cut, was the positioning belt. The one the manual says to never use in a vehicle. The one designed only to keep a person from sliding in the seat during ordinary use of the chair.
