The incident occurred during the night shift on August 21 at Santa Anita Convalescent Hospital, according to federal inspection records. CNA 3 told investigators she informed Resident 3 that she would be providing incontinent care, but the resident refused.

"CNA 3 stated she could not leave Resident 3 wet, so she insisted she needed to be changed and Resident 3 resisted," inspectors wrote.
The nursing assistant acknowledged to investigators that she never thought of leaving the resident alone temporarily or calling for another nurse or translator to better communicate with the woman. She later admitted "she should not have provided care at that time if Resident 3 said she did not want it."
The violation came to light when another aide reported what happened. During the night shift on August 22, Resident 3 told CNA 4 that "CNA 3 was rough with care and not listening or trying to understand her while providing incontinent care."
LVN 3, a licensed vocational nurse, confirmed that Resident 3's primary language was Spanish and that she was able to make her needs and wants known to staff. The nurse explained that facility policy required staff to honor residents' refusals of care.
"If Resident 3 refused ADL care, the staff should have acknowledged the resident's wants and went back later to offer ADL assistance and should have informed the LVN charge nurse," the nurse told investigators.
The facility's own policies, reviewed during the inspection, explicitly prohibit the type of forced care that occurred. The Director of Nursing explained that speaking respectfully "means using a normal tone of voice, respectful tone, explaining to the resident what is to be done, and ensure culture and language differences are honored."
When residents refuse care, the DON said, "staff should never force a resident to comply but educate them, inform the charge nurse and return later to ensure the care is provided."
The facility's Resident Rights policy, implemented in May 2023, states its purpose is "to ensure all residents are treated with the level of dignity they are entitled to while residing at the facility." The policy requires that staff "speak respectfully to residents at all times" and "treats cognitively impaired residents with dignity and sensitivity."
An older policy on Privacy and Dignity, revised in 2017, instructs staff to assist residents in maintaining self-esteem and self-worth, treating them with respect including "speaking respectfully, listening carefully."
LVN 3 warned investigators about the broader consequences of ignoring residents' rights. "Not honoring the residents' rights can upset them and can make them distrust staff there to help them," the nurse said.
The facility's Resident Rights policy, dating to 2017, mandates that the facility "must treat each resident with respect and dignity and care for each resident in a manner and in an environment, that promotes maintenance or enhancement of his or her quality of life, recognizing each resident's individuality."
Federal inspectors cited the facility for failing to treat residents with dignity and respect, finding that the forced care incident violated multiple facility policies designed to protect residents' autonomy and cultural needs.
The inspection occurred following a complaint and found the facility caused minimal harm to few residents. CNA 4 confirmed that Resident 3 was able to communicate her preferences to staff who spoke Spanish, making the original aide's decision to proceed without proper communication all the more troubling.
Resident 3's experience illustrates how language barriers can escalate into dignity violations when staff bypass established protocols for obtaining consent and ensuring cultural sensitivity in care delivery.
